This federal agency has told us they do not need to approve construction of the rail yard just east of Edmonton because it is within an existing railway line right-of-way. Although this appears to be the case for the construction of new railway “lines”, the Canada Transportation Act indicates that is not the case for the construction of new rail “yards”. Therefore, construction of this industrial rail yard must be approved by the Canadian Transportation Agency (CTA). This approval was not given before the construction started. CTA approval also triggers a federal environmental assessment, which has also not been conducted in this case.
